1. General

These General Terms and Conditions (GTC) in their currently applicable version are an integral part of any contractual legal relationship between passengers or customers and Basler Personenschifffahrt AG (BPG). They are valid for any form of contract conclusion.

By making a booking, the customer confirms their unconditional and complete acceptance of these GTC.

2. Prices/Due Date

The prices published by BPG are in Swiss Francs (CHF) including the legally owed value-added tax. Price changes are reserved.

No discounts are granted on the experience cruises (e.g., GA, half-fare card, U subscription, etc.).

The total amount is payable in advance at the time of booking by credit card or PostCard.

3. Online Booking

The online booking is binding for the customer. The contract between the customer and BPG is concluded with the unconditional acceptance of the online booking. If the customer reserves for additional participants, they are responsible for their contractual obligations (especially the payment of the purchase price) as well as for their own obligations.

All passengers need a valid travel document (voucher/booking confirmation).

4. Description of Services

The services provided by BPG can be found by the customer in the advertising materials or on the internet.

Special requests are only part of the contract if they have been confirmed in writing by BPG. Changes to services are reserved.

5. Illness/Accident

If the customer is unable to accept the agreed transportation service due to illness or accident, they can report this in writing to BPG with the submission of a medical certificate no later than two weeks after the trip. BPG will then refund the customer the total amount (minus CHF 5.- registration fee and CHF 5.- administrative costs) in value vouchers.

6. Rebooking

The customer has the option to rebook agreed transportation services to another date. A rebooking must be announced at least two weeks before the trip and is only valid if BPG confirms the new date. In this case, the customer must pay the processing fee of CHF 5.- directly on board.

7. Operational Interruption

In case of storms, high or low water, shipping bans, or the occurrence of events of a political or other nature that BPG cannot influence, operations may be restricted or completely suspended. The customer will be informed about the interruption. BPG assumes no liability in cases of such operational interruptions and is released from any compensation obligation by the customer.

8. Minimum Number of Participants

For the experience cruises, a minimum number of participants applies. BPG reserves the right to cancel the trip no later than 3 days before the event date if the minimum number of participants is not reached. The customer will be informed of the changes. In this case, the customer has the right to a refund of the amount paid.

9. Customer Obligations

The customer acknowledges the access, transport, safety, and other operational regulations of BPG and complies with the relevant instructions from their employees during the trips/events.

If the customer causes damage to furniture or facilities, they will be charged for the repair costs based on the effort involved.

10. Liability

BPG disclaims any liability for accidents during the trip/event.

11. Complaints

Complaints, defect claims, refund requests, or damage claims must be made in writing and adequately documented to BPG within 14 days of the event.

12. Data Protection

The booking data will be stored in accordance with the legal data protection regulations.

By registering for a trip, the customer agrees to receive advertising and promotional material. The customer has the option to have their name removed from the distribution list at any time.

13. Amendment of the Terms and Conditions

The BPG can adjust and change these Terms and Conditions at any time. Adjustments and changes will be communicated to the customer in an appropriate manner, particularly through corresponding publication on the website.

14. Jurisdiction

Swiss law is exclusively applicable to the legal relationship between the customer and the BPG.

The jurisdiction is Basel.

Participation Conditions Raffle

The following participation conditions are binding for entries to the raffles of Basler Personenschifffahrt AG. Participants in the raffles are required to provide all personal information truthfully. The raffles are not connected to social media services such as Facebook, Instagram, Pinterest, Tiktok, Snapchat, Twitter, or Instagram.

1. Participation:

The following participation conditions apply for a valid entry:

· Only natural persons

· Legal age (18 years)

· Residence in Switzerland

· Legal capacity

2. Exclusion from participation

Participation in the competitions is excluded for:

· Persons with an economic/employment relationship to Basler Personenschifffahrt AG

· Members of competition clubs

· Automated websites and services

· Commercial or professional participants

3. Participation deadline

The publication of the participation deadline for each competition will be published within the competition. Changes are reserved.

4. Costs

Participation in the competitions is free of charge.

5. Raffle

The raffle and winner determination take place through a random principle and in the absence of the public.

6. Notification of the winners

The winners will be notified by email within a week after
the participation deadline of the respective raffle.
Longer notification periods are reserved.

7. Prize payment / Prize transfer

Cash payments / exchange of prizes are excluded. The prize transfer takes place exclusively by post.

8. Transferability

The prize and all associated rights and obligations are not transferable to third parties and cannot be assigned.

9. Marketing

The participants agree unconditionally and without reservation by their participation that their data collected in the context of the competitions will be processed for marketing purposes. Information on data protection can be accessed at: https://bpg.ch/datenschutz. The data will be used by Basler Personenschifffahrt AG for the processing of the competition as well as for advertising purposes and for contacting. The data will only be stored as long as the purpose or a legal basis justifies the retention. During this time, Basler Personenschifffahrt AG takes all technical and organizational measures to protect the data from unlawful and incorrect processing. The affected person can assert their rights to personal data at any time. After the purpose of processing ceases or after the retention period expires, the data will be deleted in accordance with data protection regulations.

10. Expiration of the claim to the prize

Winners who do not respond to the prize notification within 2 weeks forfeit their claim to the prize.

In the case of false statements or a violation of these terms and conditions by the winners, Basler Personenschifffahrt AG reserves the right to use the prize otherwise.

A violation of these terms and conditions allows Basler Personenschifffahrt AG to exclude the affected persons from one or more competitions.

11. Cancellation of the competition / Deletion of multiple entries

Basler Personenschifffahrt AG can cancel the competition at any time and end it without handing over the prize if there is suspicion of technical manipulation. Multiple entries will be deleted on suspicion.

12. Correspondence

No correspondence will be conducted regarding the drawing of the prize competitions.

13. Disclaimer of Liability

Basler Personenschifffahrt AG is free from any liability after the prize has been sent and assumes no risk and/or further obligations.

14. Legal Recourse

Legal recourse is excluded.
